1. Please describe why you are interested in serving on the Citizens Redistricting Commission.
I view serving on the Commission as a unique opportunity as a citizen to help shape California’s political future. Drawing voting boundaries is a fundamental aspect of the structure of democracy and I would like to be part of a process that may reassure voters that they do have a voice.
Despite monumental steps forward since the passage of the Voting Rights Act, and notwithstanding the enthusiasm surrounding the 2008 presidential election, many citizens are not full participants in the electoral process, whether by choice, or because they do not feel connected to elections that appear to be more about political bargaining than about social interest. We lament the exorbitant cost of campaigns for public office and the intense activity of lobbyists. We fragment into ever narrower interest groups and sometimes seem to regard our elected officials as adversaries rather than partners.
We must do all we can to insure that the average citizen maintains faith in representative democracy. The work of the commission has the potential to move the jaded, the passive, perhaps even the cynical voter to renewed interest and participation in the electoral process if the commission reflects our diverse population, if the work is transparent, and if the work results in equitable redistricting.
I believe that our political system is capable of adapting and evolving, and with the guidance of this commission, it can incorporate the demographic, technological and economic changes that have shaped California since the last redistricting.
I want to serve because I have the skills, experience and temperament to contribute as a commissioner, and I have the freedom at this point in my life to make the necessary time commitment. I regard serving on the commission as an opportunity to apply in a meaningful way what I have learned about responsible citizenship over the course of my professional and personal life.
2. Please describe your ability to be impartial, as discussed in Regulation 60800. You may include with this description any occupational, academic, volunteer, or other life experiences you have had that demonstrate this ability.
There is no question that I hold strong social and political views ‘ they are what motivate me to be an active member of my community. I recognize that those who hold different views are just as passionate in their beliefs. What I have learned is that when I exercise patience and listen to others, I often find that we have more common ground than I anticipated.
We all carry assumptions about others within us, based on influences from home, experiences in school, and encounters in the workplace. These assumptions may manifest themselves as biases which we must be aware of and make a conscious effort to put aside. On the other hand, our personal experiences allow us to contribute an alternate perspective to an issue, which others in the group may not have seen. This is the standard I apply to any activity in which a group must reach consensus.
I have had both professional and personal experiences that have tested my ability to make objective judgments. From 1984 ‘ 1988 I served as a member of the Committee of Bar Examiners of the California State Bar. I chaired the Moral Character Sub-Committee, which considered whether candidates demonstrated moral fitness to practice law. This required reading briefs, listening to testimony, and judging an applicant’s credibility and rehabilitation. In order to evaluate an applicant’s credibility and sincerity, I had to put aside first impressions based on characteristics such as economic status, the law school they attended, or the transgression that brought them before the committee.
As an employer, I am called upon to enforce personnel policies fairly and consistently. I must apply objective standards to job performance, and disregard personal relationships and personalities. This can be especially challenging in a small business where lines of authority and responsibility are usually not as clearly drawn as in a large business with layers of management.
As President of our Chamber of Commerce from 1998-2000, I worked with a variety of business owners, many of them recent Asian immigrants seizing the unique opportunities that American commerce offers. That experience reinforced my belief that our economic and social systems are adaptive and will accommodate change if we are open to it.
During the 2008 presidential election I served as a poll monitor in Nevada. We were governed by strict rules regarding contact with voters. Despite the high emotions evident among voters, many of whom were voting for the first time in a presidential election, the monitors from each party realized that we shared a common goal of ensuring a fair election and we shared observations in a civil manner.
I have no relationships, commitments or aspirations which would subject me to undue influence as a commission member. I am financially secure, I am confident in my ability to act without bias, and I do not seek anything beyond the opportunity to serve.
3. Please describe your appreciation for California’s diverse demographics and geography, as discussed in Regulation 60805. You may include with this description any occupational, academic, volunteer, or other life experiences you have had that demonstrate this appreciation.
I can not recall a time when I was not aware of ethnic and racial differences and the social boundaries that defined those differences. I grew up in a Mexican-American community in which the Church, schools and community organizations formed strong bonds across generations of residents. My father was a leader in desegregating the public schools in San Gabriel and as a consequence, I began my education in a broader world where I encountered students of different races and economic status. This diversity is so natural to me now that I can’t imagine how someone could live in California without interacting with different groups of people, unless one made a conscious decision to be isolated.
Fortunately, I have also had the opportunity to travel extensively throughout the state and I have lived in very distinct areas, including San Diego, Los Angeles, Sacramento, and Visalia. When I lived in San Diego, we frequently crossed the border to Tijuana and I am aware of the social and economic relationships that result from the movement of residents in both directions. This same dynamic is obvious in other areas such as the central valley, where migrants are a significant part of the agricultural work force. Los Angeles defies simple categorization because of the myriad groups that self-identify by race, ethnicity, nationality, language, sexual orientation, political allegiance ‘ there is a group for anyone who seeks a familiar home. At the same time, it is important to understand that there are discrete identities within groups. There is no ‘one size fits all’ identity. Factors such as national origin and whether people are urban or rural dwellers may influence their social and political views.
In addition to personal experiences, I have had professional experiences that have expanded my knowledge of California demographics. From 1980-1982, I was President of La Raza Lawyers Association of California and traveled throughout the state to meet with Latino attorneys to build an organization to advocate for diversity in law school admissions, attorney employment, and in the judiciary. We collaborated with other minority and women’s bar associations to serve our common goal of providing effective legal services to underrepresented communities. In my current business as an insurance broker, I have represented clients from San Diego to Humboldt County. Many are non-profit organizations providing health care services to low-income communities. Their administrators and Boards of Directors are frequently challenged to increase revenue to meet their clients’ needs. I have learned a great deal about the necessity of building relationships with local, state and federal officials in order to maintain an equitable allocation of funding, particularly in rural areas, where services are limited.
4. Please describe the analytical skills you have that are relevant to serving on the Citizens Redistricting Commission, as discussed in Regulation 60827. You may include with this description any occupational, academic, volunteer, or other life experiences you have had that demonstrate those skills.
I have the requisite analytical skills to serve competently on the commission. I seek as much information as possible to make an informed decision about whatever task is at hand. I also have intuitive skills that help me listen critically to discussion and separate fact from opinion.
The specific experiences that have developed my analytical skills are as follows. My college major was English, which honed my ability to present logical conclusions drawn from facts and opinion. I am a law graduate, trained to distill relevant facts from evidence and to apply those facts to written law to support a legal argument. This background enabled me to serve on committees whose activities parallel those of the redistricting commission.
As a member of the Committee of Bar Examiners from 1984-1988, I participated in assessing the reliability of the bar exam. We received statistical reports from consultants and determined what weight should be given to each portion of the exam. This involved analyzing the relationship among the exam parts and determining whether the content effectively measured an applicant’s range of legal knowledge and his/her competence to practice law. We addressed issues such as whether the exam had a disparate impact on minorities, what accommodations would be allowed for disabled applicants, and whether any parts of the exam could be administered by computer. The Committee also considered reports on education standards, and applied those reports to determine the accreditation status of law schools.
From 1999-2003 I served as a community member of a School Site Committee for the San Gabriel USD. Roosevelt School was identified as an underperforming school with a significant number of economically disadvantaged students, many of whom were English language learners. The school was eligible for special funding to evaluate the curriculum and identify areas and methods for improving student performance as measured by the API. An external evaluator provided detailed reports to the site committee; the reports included samples of work from each grade along with indications of the performance that was appropriate for grade level. The committee met with faculty, district staff, and parents to establish specific strategies to improve student performance. By October 2002 the school had exceeded its growth target by 18 points. I was particularly satisfied that the school improved its communication with parents and provided them with information and personnel resources to enable them to provide greater support to their children’s education.
As an insurance broker, I assess a clients’ exposure to risk by compiling information on their business practices, property values, and claims history to determine the appropriate insurance coverage. My recommendations may include alternate forms of protection, such as self-insuring for loss, or transferring a risk to another entity. In order to be effective, I must be observant, I must listen to the client’s concerns and be aware of their budget constraints, and I have to understand the human dynamics that can affect the business’ risk of loss.

Activities:
Describe the professional, social, political, volunteer, and community activities in which you have engaged that you believe are relevant to serving as a commissioner, as discussed in Regulation 60847. The professional, volunteer and political activities I have engaged in are relevant to serving as a commissioner because through all of them I have developed the skills and confidence to work in cooperation with others to accomplish a stated task. A list of significant activities includes: La Raza Lawyers Association of California, the Committee of Bar Examiners of the State Bar, the Ramona Convent Secondary School Board of Directors, the Department of Insurance Curriculum Board, the San Gabriel Chamber of Commerce, La Casa Community Center, and the San Gabriel Community Foundation. I frequently assumed a leadership role in each organization either as chair or as head of a sub-committee.
When I became President of the San Gabriel Chamber of Commerce in 1998, its long-time Executive Director was about to retire. Membership was down and the City, which partially funds the Chamber, wanted assurance that the organization would remain viable. The Board reorganized the staff, cut expenses to the minimum, and set about rebuilding the membership. It was very rewarding to bring the Chamber back to financial stability and a positive outlook. This was accomplished only because the Board and city officials worked together to renew the Chamber’s mission of promoting local business.
As President of La Raza Lawyers of California I was responsible for organizing chapters throughout California, working with the Boards of each chapter to develop strategies to increase Latino representation in law schools, the bar, and the judiciary. We established relationships with the Governor’s office and the Judicial Appointments Secretary in order to recommend candidates for judicial appointment.
The experience working with elected officials in both circumstances described above gave me the confidence to approach them with the expectation that they are accountable to serve the needs of the communities they represent. That confidence is essential to commissioners who are taking on a responsibility previously reserved to legislators.
Managing fundraising events for Ramona Convent and La Casa de San Gabriel reinforced the value of working collaboratively and respecting the contributions of all volunteers. Each person is vital to the success of an event and should be recognized for his/her donation of time and resources. The commission’s work will be long and complex, and commissioners must have the patience and tolerance to listen not only to each other, but more importantly, to the citizens who testify.
I have never been a candidate for public office but I have supported local school board and judicial candidates, as well as school bond campaigns. I hosted phone banks and walked precincts; I encountered voters with divergent views and a wide range of emotions about campaign issues. Not everyone welcomed the overture. This was frustrating at times, but it did not discourage me from being an active participant in the electoral process. Commissioners should anticipate that not all the testimony they hear will be friendly and positive, but they must nonetheless remain open to gathering data and comments from as many sources as possible.

Part 4: Letters of Recommendation
An applicant must submit or arrange for the submission of three letters of recommendation from individuals or organizations. A letter of recommendation may be no longer than two pages. A description of the elements of a letter of recommendation is provided at the bureau’s web site. (Note: A public comment submitted about you will not count as a letter of recommendation.)
An applicant shall submit the required letters of recommendation to the bureau on or before April 19. Applicants shall submit the letters of recommendation to the bureau via e-mail to votersfirstact@auditor.ca.gov, or by facsimile, United States mail, or other common carrier. Letters of recommendation received by the bureau after April 19 will not be considered, and the applicant will not continue on in the application process.
On all of your letters of recommendation, you must include your application ID, which is 12283. The identification number is unique to your application and insures that each of your letters of recommendation is correctly attached to your application file before it is reviewed by the Applicant Review Panel. The letters of recommendation may be addressed to the Applicant Review Panel and can be mailed to 555 Capitol Mall, Suite 300, Sacramento, CA, 95814 in care of the State Auditor. They may also be faxed to 916-319-9295 or e-mailed to votersfirstact@auditor.ca.gov. E-mail is the preferred method of delivery.
Part 5: Financial Disclosure Form
If likely to be selected for an interview, you will be required to submit FPPC Form 700, Statement of Economic Interests. You do not need to submit that form now.
Part 6: PRIVACY NOTIFICATION AND WAIVER
LEGAL AUTHORITY AND REASON FOR COLLECTION OF PERSONAL INFORMATION
The Voters FIRST Act (the Act) and the regulations implementing the Act require that the selection of commissioners on the Citizens Redistricting Commission (commission) be open to public scrutiny and the press (see California Constitution, Article XXI, section 2, subdivision (c); California Goverment Code sections 8252, 11120, 11121, and 11125.1; California Code of Regulations, title 2, sections 60836, 60842, and 60846). The Act also requires that the Bureau of State Audits (bureau) select 60 of the most qualified applicants based upon their voter affiliation, their eligibility to serve pursuant to Article XXI of the California Constitution, the absence of any conflicts of interest, their relevant analytical skills, ability to be impartial, appreciation for California’s diverse demographics and geography, and their racial, ethnic, geographic, gender and economic diversity. To determine each applicant’s identity and qualifications to serve on the commission, and to track the demographic information of the applicant pool, this application seeks personal information about applicants that will be provided to the Applicant Review Panel, bureau staff, the public, including members of the press, the Legislature, and the commission.
CONSEQUENCE OF NOT PROVIDING ALL REQUESTED INFORMATION
Failure to provide all of the requested information will result in your disqualification and the removal of your name from the applicant pool. Thus, if you wish to serve on the commission, for each item of information requested, it is mandatory that you submit a response.
PERMISSION TO USE AND RELEASE PERSONAL INFORMATION
By submitting this application, you acknowledge that the application, all documents submitted in support of your application, including a Statement of Economic Interests (FPPC Form 700), if you are asked to submit one, letters of recommendation, materials generated as a result of any bureau or Applicant Review Panel investigation of you, and all comments about and responses to comments about your application are public records. You agree that the bureau shall provide copies of these materials to members of the public and the press, members and staff of the Applicant Review Panel, bureau staff, the Legislature, the commission, and as otherwise compelled by law. You understand that members of the Applicant Review Panel and the public may make public statements about you. You authorize the bureau to use the information submitted by and about you as the bureau deems necessary to select commissioners and replacement commissioners or otherwise comply with its legal duties, and you also authorize the bureau to post all materials related to your application to serve on the commission on its website.
VOLUNTARY WAIVER OF PRIVACY RIGHTS AND BUREAU LIABILITY
By applying to be a commissioner, you are waiving your privacy and other rights under various state and federal laws, including, but not limited to, the Information Practices Act (Cal. Civil Code section 1798 et seq.), and any defamation, invasion of privacy, and negligence claim you may have against the bureau and those acting on its behalf. Accordingly, by waiving your privacy rights, you are agreeing to permit the bureau to release any and all information submitted by or about you, EXCEPT that the bureau will not post on the Internet your date of birth, physical, mailing, and e-mail addresses (excluding the city and county), and telephone numbers, or the addresses and telephone numbers of your immediate family members. At this point in the process, the bureau will not collect, and please do not voluntarily submit to the bureau, your social security number, driver’s license number, financial account numbers, or health information. By submitting your application, you acknowledge and consent to the release of the information you and others are providing related to you, and except as specifically provided above, you are waiving your right to privacy regarding all information relating to you and your application to serve as a commissioner. This waiver authorizes the bureau to make public information submitted by or about you for a period of twelve (12) years from the date of your application, even if you are not selected as a commissioner. You are providing this waiver voluntarily, understanding that the bureau shall not be legally liable as a result of the release of information submitted by or about you, or as the result of comments made about you by others, that the bureau posts on its website or otherwise releases publicly. This includes claims of defamation, invasion of privacy, negligence, and any other statutory or common law claims.
