1. Please describe why you are interested in serving on the Citizens Redistricting Commission.

I am applying to serve on the Citizens Redistricting Commission out of a deep concern that unless reformed, California may be unable to effectively address the problems it faces as well as maximize the opportunities that will enable the people of California to pursue and fulfill their potential.

California currently suffers from many problems ranging from a weakened economy, water shortages, environmental change, global warming, land use, pollution, less than satisfactory schools, financially stressed university and social service systems, and of course the state budget in all its ramifications. It also suffers from a taxation system that many consider overburdens business and is too volatile. If these issues are to be effectively addressed in a manner consistent with the desires and aspirations of the California citizenry, the legislature must be effective. With the current method of determining legislative districts, it is not.

Legislative districts should represent communities of interests. This is inherently difficult in California given its regional and demographic diversity. As Mark Baldassare put it in his book, ‘California in the New Millennium’, California is in many ways four states with mutually suspicious ethnic communities all of which distrust the government. I believe these differences can be overcome provided the districts are based on communities of interest criteria: geographic, ethnic, economic and many others. As it stands now however, the primary community of interest is political party registration. This effectively results in many single party legislative districts that may not represent communities of interest that reflect our common interests in solving the problems facing the state. With single party districts and typically low turnout primaries, party activists who are more ideologically, rather than consensus or compromise, driven exercise a disproportionate influence on who is nominated and therefore who is elected than the public at large in their districts. This results in a Legislature excessively polarized and gripped by legislative gridlock.

California cannot successfully address its problems and build on its opportunities without ridding the Legislature of this partisan paralysis. This paralysis can only be overcome by developing legislative districts that are based on community of interest criteria other than political parties so that compromise and consensus building can be returned to our political process. We must refocus on the goal of solving the peoples’ problems rather than exercising political oneupsmanship. California can have bright, robust future but not with the current method of creating Legislative districts. I believe my background and experience would be useful on the Commission in developing districts that will return effective, problem solving legislators to Sacramento.

2. Please describe your ability to be impartial, as discussed in Regulation 60800. You may include with this description any occupational, academic, volunteer, or other life experiences you have had that demonstrate this ability.

As a small business person, owner of an independent bookstore and third generation family farmer, I have no personal, family, financial relationships, commitments or aspirations that would improperly influence me in making a redistricting decision.

I have served in many capacities in which I have had to act as an impartial decision maker.I served ten years on the Davis School Board (1987-1996), and four years on the Davis City Council (1996-2000)and three years as President of the Davis Downtown Business Association. I also served as Senior Warden of my parish (Episcopal) and on the Board of Directors of Episcopal Community Services. In each of these roles I had to work with many others of diverse views to forge policies and solutions to a variety of issues.

Davis is an intensely political town with an intelligent, educated, opinionated populace. On both the School Board and the City Council members are elected at large. As a result, Board and Council members must represent not just one aspect or section of the community but look for solutions that meet the needs of all the aspects of the community, a community that expects to have its views listened to and reconciled. I sought to do this in several ways.

First, I encouraged all interested parties to participate and express their views. Effective leadership in Davis required reaching out and soliciting the widest possible points of view. And it was critical that those asked to participate believed their contribution mattered. For the School Board I proposed that we hold some of our Board meetings at the schools rather than just at the central office. I urged the Council to both meet in the community and to have public subcommittee meetings in the various neighborhoods so it would be easier for people to participate. Both programs were very success and well received by the community.

Second, I listened most closely to those with whom I disagreed. I found that I learned the most by listening to those with whom I did not agree. Listening to them also helped me to understand what really concerned those with viewpoints that differed from mine. This helped me to craft approaches that would meet their needs as well as mine. Here is a small but illustrative example of this process. One group of citizens wanted to ban leaf blowers outright. Another saw them as necessary. By listening to those who wanted a ban I learned what concerned them was the noise. Therefore, I proposed an ordinance not based on winning or losing but based on noise level. So long as noise from leaf blowers did not exceed the background ambient noise, they could be used.

My goal in public service has been to solve problems that work for as many people as possible. Whether those solutions ultimately mirror my views reflect my views is not my objective. While I may be a quick study, I am willing to be persuaded other approaches are better than mine.

3. Please describe your appreciation for California’s diverse demographics and geography, as discussed in Regulation 60805. You may include with this description any occupational, academic, volunteer, or other life experiences you have had that demonstrate this appreciation.

California is our nation’s most diverse state, and there is every reason to believe that that diversity will only increase given immigration and the higher birthrate of our new residents. This can and should be a source of strength, energy, and vitality. But the benefits are not automatic. Left unrecognized, diversity can be a source of social and political corrosion that can result when a population feels alienated and excluded from the political process and proposals made to address California’s opportunities and problems.

I have made a special effort in my public service to recognize, anticipate, and address the increasing diversity in the state. The Davis School Board on which I served was one of the first in the state to adopt a multi-cultural curriculum. I was a very strong supporter and in fact was the swing vote in adopting a demand driven K-6 Spanish immersion program believing that given the demographic trends of the state, we should encourage the next generation to be bilingual. Also recognizing the role that migrant labor played in the state, the Davis School District adopted a school year for migrant children that met their educational needs shifting their school year to April to October so it corresponded to their parents coming from Mexico to work on the farms. Finally, we insisted that our Personnel director recruit in southern California so we would access to a more diverse pool of potential teachers from which to recruit than if he had only recruited in Northern California.

On the City Council I made a concerted effort to recognize economic diversity and insure that low income residents who find it difficult to participate politically were represented. I worked to ensure that 25% of low income housing was incorporated into new housing projects and integrated into the community at large. This recognition of the economic diversity and the need to provide opportunities for the less economically well off is balanced by my careers as a third generation farmer and small business owner. In these capacities I am aware first hand of the challenges faced by the private sector as it works to provide jobs and money to pay the taxes that support the state’s social safety net.

I have also personally pursued my interest in other cultures. My graduate work at UCLA was in Russian and Japanese History. I have developed some ability to speak Russian and German. I have been an active participant in Sister Cities with Uman, Ukraine initiating and arranging funding for a three year teacher exchange program as well as a variety of other exchanges. I also funded pediatric dental clinics at elementary schools in Uman and initiated and funded a scholarship program at the Uman Agricultural Institute where currently ten students are on scholarships I underwrite. More than 50 of my scholarship recipients have graduated. For these activities I was awarded and honorary doctorate and a medal as Patron of the City.

California’s future is as a state in which no group is a majority. An effective political system requires that our legislature reflect that diversity.

4. Please describe the analytical skills you have that are relevant to serving on the Citizens Redistricting Commission, as discussed in Regulation 60827. You may include with this description any occupational, academic, volunteer, or other life experiences you have had that demonstrate those skills.

I graduated with a Doctor of Jurisprudence degree from Vanderbilt University and was an Associate Lw Review Editor. I was trained to write, analyze and argue data. My primary professional responsibility was to write appellate briefs applying both statutory and constitutional law.

Prior to law school I monitored food stamp fraud for the USDA in the western region (10 states) and analyzing data trends and overall levels of fraud. In graduate school at UCLA I analyzed data to determine political development in Tsarist Russia and the role economic stability played in Japan in the restoration of the emperor.

In fourteen years of public office, I reviewed volumes of data on budgets and other issues, and lengthy and complex documents like environmental impact reports covering topics as diverse as traffic flows and burrowing owls. In analyzing these documents I had to know the material so I could ask key questions and see how the various parts fit together and whether they met legal standards. In several instances on the City Council I found data and staff conclusions to be wrong in one case leading to a referendum overturning a Council decision.

On the School Board I studied racial and economic demographic data to determine where new schools should be built that would provide the greatest ethnic and economic diversity within the limits of where growth required new schools. As Davis Downtown Business Association President, it was my responsibility to analyze city actions as they affected the downtown and to present the business point of view to the Council.

In my capacity as an elected official as well as parish Senior Warden I both participated in and chaired countless public meetings in which people with strong and diverse views presented their facts and opinions. As a participant, it was my responsibility to separate opinion from fact and to ask clarifying and probing questions. As chair, it was my role to ensure that all had an opportunity to participate and express their views while insuring the meeting remained focused and proceeded in a timely manner. It was also my responsibility to fairly summarize testimony and promote civility.

I am familiar with word processing and basic spread sheet programs.

From 2000 to 2004 I was a columnist for the Davis Enterprise and have significant experience writing op-ed pieces on a variety of subjects. I am often asked to moderate community forums as well as present information in public debates including giving testimony to the legislature and speaking publically to the media.

I have made a point of reading relevant material including three books that provide insight into that diversity: Peter Schrag’s ‘Paradise Lost’ in which he discusses the impact of initiative process on California politics and ‘California: America’s High-Stakes Experiment’ in which he sets forth some of the very issues the Redistricting Commission will seek to address, and finally mark Baldassare’s book ‘California in the New Millennium’ in which he argues in many ways California is really four states. While on the School Board I earned an emergency credential from UC Davis and was a long term substitute teacher at the continuation high school for the Woodland Joint Unified School District.I have a life time Junior College history teaching credential.

I served as Senior Warden of my parish church, as well as a board member for Episcopal Community Service, and a member of the Diocesan Council (Episcopal Diocese of Northern California).

I served three years as President of the Downtown Davis Business Association and an additional three years as a board member.I have volunteered for a variety of local political campaigns including city council, school board, library bonds, school bonds, and several local initiatives and referendae. I serve on the board of Uman (Ukraine)-Davis Sister Cities and for many years coached youth soccer and baseball.

Part 4: Letters of Recommendation

An applicant must submit or arrange for the submission of three letters of recommendation from individuals or organizations. A letter of recommendation may be no longer than two pages. A description of the elements of a letter of recommendation is provided at the bureau’s web site. (Note: A public comment submitted about you will not count as a letter of recommendation.)

An applicant shall submit the required letters of recommendation to the bureau on or before April 19. Letters of recommendation received by the bureau after April 19 will not be considered, and the applicant will not continue on in the application process.

On all of your letters of recommendation, you must include your application ID, which is 5926. The identification number is unique to your application and insures that each of your letters of recommendation is correctly attached to your application file before it is reviewed by the Applicant Review Panel. Part 6: PRIVACY NOTIFICATION AND WAIVER

LEGAL AUTHORITY AND REASON FOR COLLECTION OF PERSONAL INFORMATION

The Voters FIRST Act (the Act) and the regulations implementing the Act require that the selection of commissioners on the Citizens Redistricting Commission (commission) be open to public scrutiny and the press (see California Constitution, Article XXI, section 2, subdivision (c); California Goverment Code sections 8252, 11120, 11121, and 11125.1; California Code of Regulations, title 2, sections 60836, 60842, and 60846). The Act also requires that the Bureau of State Audits (bureau) select 60 of the most qualified applicants based upon their voter affiliation, their eligibility to serve pursuant to Article XXI of the California Constitution, the absence of any conflicts of interest, their relevant analytical skills, ability to be impartial, appreciation for California’s diverse demographics and geography, and their racial, ethnic, geographic, gender and economic diversity. To determine each applicant’s identity and qualifications to serve on the commission, and to track the demographic information of the applicant pool, this application seeks personal information about applicants that will be provided to the Applicant Review Panel, bureau staff, the public, including members of the press, the Legislature, and the commission.

CONSEQUENCE OF NOT PROVIDING ALL REQUESTED INFORMATION

Failure to provide all of the requested information will result in your disqualification and the removal of your name from the applicant pool. Thus, if you wish to serve on the commission, for each item of information requested, it is mandatory that you submit a response.

PERMISSION TO USE AND RELEASE PERSONAL INFORMATION

By submitting this application, you acknowledge that the application, all documents submitted in support of your application, including a Statement of Economic Interests (FPPC Form 700), if you are asked to submit one, letters of recommendation, materials generated as a result of any bureau or Applicant Review Panel investigation of you, and all comments about and responses to comments about your application are public records. You agree that the bureau shall provide copies of these materials to members of the public and the press, members and staff of the Applicant Review Panel, bureau staff, the Legislature, the commission, and as otherwise compelled by law. You understand that members of the Applicant Review Panel and the public may make public statements about you. You authorize the bureau to use the information submitted by and about you as the bureau deems necessary to select commissioners and replacement commissioners or otherwise comply with its legal duties, and you also authorize the bureau to post all materials related to your application to serve on the commission on its website.

VOLUNTARY WAIVER OF PRIVACY RIGHTS AND BUREAU LIABILITY

By applying to be a commissioner, you are waiving your privacy and other rights under various state and federal laws, including, but not limited to, the Information Practices Act (Cal. Civil Code section 1798 et seq.), and any defamation, invasion of privacy, and negligence claim you may have against the bureau and those acting on its behalf. Accordingly, by waiving your privacy rights, you are agreeing to permit the bureau to release any and all information submitted by or about you, EXCEPT that the bureau will not post on the Internet your date of birth, physical, mailing, and e-mail addresses (excluding the city and county), and telephone numbers, or the addresses and telephone numbers of your immediate family members. At this point in the process, the bureau will not collect, and please do not voluntarily submit to the bureau, your social security number, driver’s license number, financial account numbers, or health information. By submitting your application, you acknowledge and consent to the release of the information you and others are providing related to you, and except as specifically provided above, you are waiving your right to privacy regarding all information relating to you and your application to serve as a commissioner. This waiver authorizes the bureau to make public information submitted by or about you for a period of twelve (12) years from the date of your application, even if you are not selected as a commissioner. You are providing this waiver voluntarily, understanding that the bureau shall not be legally liable as a result of the release of information submitted by or about you, or as the result of comments made about you by others, that the bureau posts on its website or otherwise releases publicly. This includes claims of defamation, invasion of privacy, negligence, and any other statutory or common law claims.
